Privacy practices for colormodepainting.com
Effective date October 18, 2026

Scope and summary

This Privacy Policy explains how Color Mode Painting LLC, a Florida limited liability company, collects, uses, discloses, and retains personal information through colormodepainting.com, our estimate and contact forms, customer and project-management tools, and related calls, texts, emails, and business records. A separate notice may provide additional information about a particular service or relationship.

We use information to respond to requests, prepare and administer estimates and projects, work with subcontractors, maintain customer and payment records, operate and secure our systems, understand website use, and advertise our services. We do not sell personal information for money. Some advertising and analytics disclosures may be considered a sale, sharing, or targeted advertising under certain state laws.

Our Privacy & cookies banner provides separate choices for supported Website analytics, Marketing tools, and OpenAI ad measurement. Optional tools remain off until their category is permitted. You can request an estimate without allowing optional tracking. These choices do not authorize marketing calls, texts, or emails.

Information we collect

Contact and request information: name, email address, telephone number, service address, preferred contact method, project type, timing, and details you provide in forms or messages.

Estimate and project information: appointment details, property and surface information, measurements, photographs, documents, proposals and revisions, customer responses and approvals, project communications, schedules, work history, and other records needed to provide services.

Billing and payment records: invoices, payment amounts and dates, payment methods, transaction references, payment status, and related correspondence. We accept Chase POS payments, Zelle, checks, and cash. Information you provide directly to a payment provider or your bank is also governed by that provider's practices. Our business records may include information appearing on checks, receipts, and payment confirmations. Do not send full payment-card details, account passwords, or online-banking credentials through a general website form or ordinary message.

Account and operational information: account contact details, access and security information, preferences, and activity associated with business tools. When you work with us as a subcontractor, we may also maintain business contact information, project assignments, documents and payment instructions you provide, and payment records.

Device and usage information: IP address, browser and device information, pages viewed, referring pages, approximate location inferred from IP address, timestamps, interactions, and server or security logs.

Cookie and advertising information: stored preferences, cookie or online identifiers, ad-click references, campaign information, and conversion events. The OpenAI feature has the specific limits described below.

Communications and preferences: correspondence, request-related communications, marketing choices, opt-outs, and consent records. We will provide any notice or obtain any consent required before recording a call.

Information from others: information supplied by property owners or authorized representatives, referrals, service providers, advertising or analytics providers, and public property records, where permitted by law.

How we collect and use information

We collect information when you submit a form, communicate with us, provide project materials, use an online tool, approve a proposal, make a payment, or work with us. We also collect information through server logs, cookies, pixels, tags, browser storage, and similar technologies. We may use this information to:

  • Respond to inquiries, schedule appointments, prepare and revise proposals, and follow up on requested work.
  • Administer accepted projects, coordinate staff and subcontractors, document work, communicate changes, and handle customer service or warranty matters.
  • Maintain proposals, approvals, invoices, payment and accounting records, and other business records.
  • Translate customer-facing proposal text, as described below.
  • Operate, troubleshoot, improve, and secure the website and business tools; prevent misuse, fraud, and duplicate submissions.
  • Understand website use and measure advertising performance, subject to applicable law and the choices described in this Policy.
  • Send marketing communications when permitted by law and consistent with your choices.
  • Comply with law, protect rights and safety, resolve disputes, and establish, exercise, or defend legal claims.
  • Carry out a proposed or completed business transaction, such as a financing, reorganization, merger, or sale, subject to appropriate safeguards.

Estimate requests and communications

Submitting an estimate or contact request authorizes us and providers working for us to use the supplied information to respond to that request by phone or email. Text-message permission is requested separately as described below. Request-related communications may include appointment confirmations, estimate follow-up, scheduling, and project administration. Message and data rates may apply. This is separate from optional advertising measurement and from consent to automated marketing.

If we offer marketing calls or texts, we will use a separate, unchecked choice with program-specific disclosures. Marketing consent is not a condition of purchasing services. You may revoke marketing consent through any reasonable method, including replying STOP to a text or emailing info@colormodepainting.com. For marketing email, use the unsubscribe link or contact us. We may retain a suppression record to honor your choice. An opt-out does not prevent nonmarketing communications permitted by law about a current request or existing transaction.

Optional estimate and appointment texts

If you separately opt in to our estimate and appointment text program, we use your mobile number and consent record to send request-related replies, confirmations, reminders and appointment updates. For this SMS program: We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. This restriction includes affiliates and covers SMS opt-in and consent records. Providers may process this information only as needed to operate and protect the messaging service on our behalf. The advertising and analytics choices elsewhere in this Policy do not apply to SMS consent. Reply STOP or contact info@colormodepainting.com to withdraw; we keep a limited suppression record to honor that choice. Withdrawing from texts does not cancel a booked estimate or prevent support by phone or email.

AI-assisted customer-service texts

When you text our public number, an AI assistant may answer your question using our messaging and AI service providers. Your message content, conversation identifiers, and the information you choose to provide are processed to answer service questions and help with estimate requests. Replies identify the assistant as AI. You can ask for a person; authorized staff can take over the conversation. AI may respond at any hour, while human text support and routine scheduled notifications operate during the posted business hours. Customer-service messages, delivery records, and necessary consent or opt-out evidence are saved separately in our private business system under this Policy’s business-record retention criteria; the seven-day routine assistant-platform transcript setting is not a deletion promise for those business records. Starting a service conversation does not enroll you in recurring appointment reminders or marketing. Do not text passwords, payment-card details, verification codes or other unnecessary sensitive information. Contact info@colormodepainting.com if you prefer human assistance or have a privacy request.

AI phone assistance and call privacy

AI phone service. Calls to our public number may connect directly to our AI assistant. Its opening message identifies it as AI, explains processing and transcription by third-party providers and asks whether you agree to continue. Human transfers occur only when you explicitly request to speak with a person or our team. Audio reaches our telephone and AI providers before you answer that opening question. We do not use a separate keypad consent menu.

What the assistant does and what it processes

The assistant can answer general questions about our painting services, collect information for an estimate request, and help route a caller to our team. It is an artificial intelligence system, not a human. AI responses can be inaccurate. Pricing, availability, appointments, project scope, and contractual commitments require confirmation by our team through the applicable estimate or agreement.

Depending on what you provide, the service processes your voice in real time, a text transcription of the conversation, your caller number and call metadata (such as time, duration, and routing status), and contact or project details such as your name, email, service location, painting needs, and preferred callback time. A call summary or estimate-request record may be created for our team. Please provide only information needed for your inquiry. Do not share passwords, verification codes, Social Security numbers, full payment-card details, bank credentials, medical information, or other unnecessary sensitive information.

Providers and purposes

We use Twilio for telephone connectivity and ElevenLabs for AI voice assistance. ElevenLabs, its affiliates, and its service providers, including the language-model provider selected for the assistant, process the interaction to operate the service. Relevant information may also be available to our authorized staff and providers who handle the inquiry. We use it to respond to your request, prepare estimates, arrange follow-up, route calls, review service quality, troubleshoot problems, and protect the service. Provider processing is subject to the applicable service agreements, settings, and legal requirements. See Twilio’s privacy notice and ElevenLabs’ privacy policy. Processing may occur in the United States or other countries as described in this Policy.

Notice, consent, and your choice

Before a substantive AI-assisted conversation, we will identify the assistant as AI, explain the relevant processing and any recording or transcript retention, and obtain consent where required. We will not treat visiting this website, accepting website cookies, or simply dialing our number as a substitute for any required call-specific consent. A website estimate request or consent to this service does not by itself authorize automated marketing calls or texts.

You can decline AI assistance or ask to speak with our team. You can also contact us without using the AI assistant by emailing info@colormodepainting.com or using our contact form. A human transfer or callback depends on team availability and is not guaranteed to be immediate. If you withdraw consent during a conversation, the AI-assisted interaction should stop; this does not undo earlier lawful processing. The service is not an emergency service and cannot contact emergency services for you. In an emergency, call 911 directly.

Verified cancellation of estimate visits

When you explicitly request cancellation through the assistant, we use the booking email, callback number and appointment date to request a verification link. If those details match one upcoming estimate visit, the link is sent only to the email address already on that booking. The link expires after 30 minutes and requires a separate confirmation on our website. Requesting or opening the email alone does not cancel a visit. After confirmation, we release the calendar time, stop pending reminders and queue cancellation notices for the customer and our office. This process applies to estimate visits, not cancellation of signed painting contracts or active work. Contact our office if you cannot access the booking email.

Website chat and browser voice

If you accept AI processing, we store a signed preference in a functional cookie in this browser for seven days so you do not have to accept again each time you switch between text chat and browser voice. The cookie contains a version and expiration; it does not contain your name, email or phone number. You can remove it using “Clear saved consent” in the assistant panel. This preference applies to the browser, does not verify a person’s identity and does not carry across devices; clear it when finished on a shared device. Separate optional-cookie preferences remain available through “Privacy & cookies” in the footer and are remembered for up to 180 days, unless a change requires a new choice.

Our website may offer text chat and browser-based voice conversations with the same AI service. Before connecting, we present a notice about AI processing, third-party providers, transcription and routine transcript retention, and ask you to agree and start the conversation when this browser has no current saved acceptance. Voice mode also requests microphone access from your browser. You can choose text chat or email instead. Messages and voice are processed by the providers described above; routine assistant transcripts are kept for up to 7 days. Confirmed estimate inquiries and appointment details saved separately in our business system follow the business-record retention criteria in this Policy. Providing a callback number does not enroll you in text reminders or marketing.

Recording, retention, and privacy requests

Our current standard is not to store call-audio recordings and to limit routine AI conversation transcripts in the assistant platform to 7 days. Real-time voice processing and transcription still occur even when audio recording storage is disabled. We will disclose any different recording practice and obtain any consent required before it applies.

The 7-day transcript period does not apply to information needed in a separate estimate request, callback task, accepted project, invoice, or other business record. Those records follow the retention criteria elsewhere in this Policy. Telephone-provider call metadata, security records, backups, and records subject to legal preservation may have different retention periods. Limited consent evidence collected by our earlier keypad notice is kept separately for at least 5 years, or longer where required. In the current direct-to-AI flow, the caller’s response to the opening notice is part of the routine transcript and follows its 7-day retention; we do not currently create a separate long-term consent record for that flow.

To ask about your call information, request access, correction or deletion where applicable, or raise a concern, email info@colormodepainting.com. We may verify your identity and apply legal exceptions. We will not ask for your account password or verification codes to handle a privacy request.

Cookies, Google tools, and security services

Cookies and similar technologies support website functions, preferences, analytics, advertising, and security. We use Google analytics and advertising tools, which may receive device and online identifiers, IP address, browser information, website activity, and advertising or conversion data. The banner's Website analytics choice controls supported Google Analytics and phone-click measurement scripts; its OpenAI category does not change that choice. Google explains its practices at https://policies.google.com/privacy.

The website may use Cloudflare Turnstile and related services to detect automated abuse and protect submissions. These services may process device, browser, network, interaction, and security information. Cloudflare's policy is at https://www.cloudflare.com/privacypolicy/.

Use Privacy & cookies to reopen the banner and change your choices at any time. Reject optional turns off all supported optional categories; Preferences lets you change them separately. The Marketing tools category controls supported frontend scripts identified on our site as Groundhogg and Hostinger Reach. These controls cover supported integrations, not every third-party technology or server-side business process. Essential website, form, security, and preference functions remain available. Google advertising storage, advertising user data, and advertising personalization remain denied in the current consent configuration. You can also manage cookies through your browser settings. Blocking or clearing storage may affect website functions and erase saved preferences. Provider account settings and industry opt-out tools may limit some interest-based advertising, but may not stop every advertisement or measurement activity. Where applicable law requires us to recognize an opt-out preference signal such as Global Privacy Control, we will process that signal as required. We do not currently respond to other browser Do Not Track signals because there is no uniform industry standard.

Optional OpenAI advertising measurement

If you permit OpenAI ad measurement in the banner, we may send OpenAI a limited signal that an estimate request was successfully submitted after an eligible ad visit. This helps measure the performance of advertising on OpenAI services.

Our current implementation sends a submission event, an opaque event identifier used to recognize repeat attempts for the same submission, and an ad-click reference supplied in the landing-page URL. OpenAI also receives ordinary connection information, such as IP address and browser information. These identifiers and technical information are not necessarily anonymous.

We do not include the name, email address, telephone number, service address, project description, photographs, proposal content, or other submitted form values in this measurement request. The feature does not use automatic advanced matching or send events from private customer proposals, invoices, staff pages, or the private portal.

An event requires your current permission, an eligible reference observed in the same browser tab, and confirmation that our server accepted the estimate request. The reference can be used for up to 30 minutes after capture; refreshing the page does not extend that period. Visiting a confirmation page by itself does not qualify. Returning later or using a different tab may not produce an event.

We remember your category choices in a first-party preference cookie for up to 180 days after you save them, unless you change them, a consent revision requires a fresh choice, or your browser removes the cookie sooner. The record contains choices, timing, and version information, not an advertising identifier. A separate preference cookie communicates your OpenAI allow or decline choice to the measurement feature.

Use Privacy & cookies to withdraw a category or select Reject optional to turn off all supported optional categories. Withdrawing a category whose optional scripts have already loaded reloads the page to stop those scripts. No estimate submission is required. Another browser or device may require a separate choice. Withdrawal does not undo events already sent or automatically delete records held by providers. The 180-day preference period and the 30-minute ad-reference window are not retention limits for previously transmitted events or ordinary customer records.

OpenAI generally processes conversion information as an independent controller under its applicable advertising terms, including for measurement, optimization, delivery, and improvement of its services. Its practices and choices are described at https://openai.com/policies/privacy-policy/ and https://openai.com/policies/conversion-terms/. The OpenAI category governs this feature only; it does not change the other categories described above.

Proposal translation with DeepL

We use DeepL to help translate customer-facing proposal text. Text selected for translation is sent to DeepL, and may include project information appearing in that text. A translation request can occur before an edited proposal is saved, so discarding an edit does not necessarily undo a transmission that has already occurred.

Translated content may be retained in our proposals and business records. Our software also supports temporary translation caching; a cache period is separate from the retention of an accepted proposal or the provider's own records. DeepL explains its processing at https://www.deepl.com/en/privacy. Please avoid including unnecessary sensitive information in project descriptions. Contact us about translation concerns before approving a proposal.

How we disclose information

We may disclose relevant information to staff and subcontractors involved in estimating, scheduling, performing, documenting, or administering your project. We may also disclose information to:

  • Hosting, form, customer-management, email, telephone, text, scheduling, document-storage, translation, payment, information-technology, and security providers supporting our operations.
  • Analytics and advertising providers as described above.
  • Professional advisers, insurers, auditors, and other parties needed to manage business or legal matters.
  • Government agencies, courts, law enforcement, or others when disclosure is required or permitted by law, needed to protect rights or safety, or necessary to investigate fraud or misuse.
  • Participants in a proposed or completed business transaction, subject to appropriate safeguards.
  • Other parties at your direction or with your consent.

Providing photographs or documents for a project does not by itself authorize us to publish them in advertising. We do not sell personal information for money. Advertising disclosures may nevertheless be classified as sale, sharing, or targeted advertising under applicable law. We do not knowingly sell or share personal information about children under 16 for targeted advertising.

Retention and security

We retain information for as long as reasonably necessary for the purposes described here, including estimates, projects, accounting, tax, insurance, warranty, communication preferences, legal requirements, and dispute resolution. Periods vary by record type and circumstances. Asking us to close an inquiry does not necessarily require deletion of records we must or may lawfully retain. Copies may also exist in backups or recovery records. Contact us to request deletion or ask about a particular record. We assess requests and applicable exceptions rather than promising a single automatic deletion period for all records.

We use administrative, technical, and physical measures we consider reasonable for the information and our operations. No system is completely secure. This Policy does not promise that every file is encrypted or that unauthorized access can never occur. Please do not submit Social Security numbers, financial-account credentials, medical information, or other unnecessary sensitive information through general forms. We will address security incidents as applicable law requires.

Your choices and rights

You may contact info@colormodepainting.com or (954) 635-5338 to correct contact information, close an inquiry, stop marketing, or make a privacy request. Manage optional tracking through Privacy & cookies as described above.

Depending on your location and whether a law applies to our business and the information, you may have rights to access or obtain a copy of information, request correction or deletion, obtain information about processing, or opt out of certain sale, sharing, targeted advertising, or profiling. Additional rights, including an appeal of a decision or use of an authorized agent, may apply. We may need information to verify identity or authority and will respond as required by applicable law. Rights are subject to legal exceptions. We will not unlawfully discriminate against you for exercising applicable rights. Withdrawing consent applies prospectively and does not affect earlier lawful processing.

Children, location, and other websites

Our services and website are intended for adults arranging painting services and are not directed to children under 13. If you believe a child has provided personal information without appropriate authorization, contact us so we can review it.

We operate in the United States. Providers may process information in the United States or other countries under their applicable arrangements. Other websites and services linked from our website have their own privacy practices; review those notices when using them.

Changes and contact

We may update this Policy by posting a revised version and changing its effective date. We will provide additional notice or obtain consent when required by law. A policy update does not by itself override an existing choice or authorize materially different processing where additional permission is required.
